Cox ESIGN Consent to Use Electronic Records and Signatures (ESIGN Consent)
Cox
Communications Inc. and its affiliates (Cox) are required by law to
provide to you certain documents and/or information in writing. With
your prior consent, we may provide this information to you
electronically (“Electronic Records”). We also seek your consent to use
Electronic Records and signatures throughout our relationship with you.
So, before you complete this transaction or use any of the services
associated with this transaction, you must review and consent to the
terms outlined below. Please read the information below carefully and
thoroughly. If you agree to these terms and conditions, please consent
by checking the acknowledgement box, and submitting your order.
Transactions Subject to this Consent.
This notice and
consent apply to your Device Payment Plan (“DPP”) Agreement, any related
documents, and any documents or information provided in connection with
the servicing of your DPP Agreement. You also agree that we may satisfy
our obligation to provide you with an annual copy of our Privacy Policy
and/or GLBA Privacy Notice by keeping it available for review on
www.cox.com, or, with prior notice to you, on another website where we
offer our products or services.
You are not required to consent
to doing business in an electronic format. If you do not consent, do not
check the acknowledgement box or attempt to submit your order. If you
do not consent, Cox will not be able to complete this transaction and
provide you with these service(s) or products.
We may always, in
our sole discretion, provide you with any communication via paper, even
if you have chosen to receive it electronically.
Sometimes the law,
or our agreement with you, requires you to give us a written notice.
You must still provide these notices to us on paper, unless we
specifically tell you in another communication how you may deliver that
notice to us electronically.
Option to Receive Paper Documents and Electronic Copies.
You
do not have an option to receive your DPP Agreement or any related
documents in paper; however, once you have executed the DPP Agreement,
and any related documents, you will have the ability to download and
print these documents directly by logging in to your Cox MyAccount.
Withdrawing Your Consent.
After you have executed the DPP
Agreement, and any related documents, you may subsequently withdraw your
consent to electronically receive any documents or information related
to the servicing of your DPP Agreement at any time. Please be aware,
however, that withdrawal of consent may result in the termination of
your access to our services and your ability to use certain Cox
products.
Your withdrawal of consent will become effective after we have had a reasonable opportunity to act upon it.
If
you are receiving online account statements and you terminate your
consent, you will need to contact us each month at the below mailing
address to request that a paper statement be mailed to you via the U.S.
Postal Service or other courier.

You must keep your email or electronic address current with us.
You
must promptly notify us of any change in your email or other electronic
address. Sign on to your Cox online account to update your contact
information and change the email address on record for you. There may be
other, special Cox products or services for which we provide separate
instructions to update your email or other electronic address.
Hardware and Software Requirements.
To receive Electronic Records, you must have access to:
We reserve the right to discontinue support of a current version of
software if, in our sole opinion, it suffers from a security flaw or
other flaw that makes it unsuitable for use with our services.
If
our hardware or software requirements change, and that change would
create a material risk that you would not be able to access or retain
your Electronic Records, we will give you notice of the revised hardware
or software requirements. Continuing to use our services after
receiving notice of the change is reaffirmation of your consent.
By
checking the acknowledgment box, and submitting your order, you consent
to conduct this transaction (on behalf of yourself and all the other
account owners, authorized signers, authorized representatives), and to
sign any agreements or other documents related to this transaction,
electronically. You also consent to receive electronically any documents
or information provided in connection with the servicing of your DPP
Agreement. You also confirm that you have the hardware and software
described above, that you are able to receive and review Electronic
Records, and that you have an active email account.
