Additional terms and conditions

These Additional Terms and Conditions for Purchased Content (“Terms") set forth additional terms and conditions applicable to your purchase of video content from Cox through your Contour TV Service (“Purchased Content"). These Terms apply only to Purchased Content, and not any other Cox TV Services, including, but not limited to, rental video-on-demand or pay-per-view content, or other Cox services. For purposes of clarification, these Terms are in addition to the terms contained in the Residential Customer Service Agreement (“Customer Agreement”) and purchasing content through your Contour TV service and Purchased Content is a Cox Service, as that term is defined in your Customer Agreement. Purchasing content and Purchased Content are subject to all terms and conditions contained in the Customer Agreement which can be found on www.cox.com under Policies. Further, accessing purchased content through watchtv.cox.com is subject to the Cox Online Privacy Policy, which also can be found on www.cox.com. In the event of a conflict between these Terms and your Customer Agreement or Online Privacy Policy these Terms shall control. Terms used, but not defined herein, have the meaning given in your Customer Agreement.

Purchasing Content

When you purchase Purchased Content, Cox will charge you the price for the Purchased Content, and also any applicable sales tax, franchise fees or other applicable fees. All purchases of Purchased Content are final and non-transferable. Cox does not offer exchanges or refunds. The price of a given piece of Purchased Content may change at any time. Cox does not offer you price protection or refunds in the event of a decrease in price, whether through a promotional offering or otherwise.

Device Requirements

In order to view Purchased Content on devices other than select Contour On Demand-enabled set-top-boxes, you will need to register a device that satisfies the minimum requirements set forth in the FAQ’s which can be accessed by clicking here. Cox may change these requirements from time to time with or without notice to you. You are responsible for checking the requirements listed in the FAQ’s under “What equipment do I need” for updates. Whether a device satisfies the requirements of a Compatible Device, as that term is defined in the FAQ’s, depends on a number of factors outside of Cox's control, including the software and systems provided or maintained by the device manufacturer or other third parties. Devices that are Compatible Devices at one time may cease to be Compatible Devices in the future. In order to view Purchased Content, you may be required to download and install additional software on your Compatible Devices, such as Cox mobile applications ("Access Software"). If the Compatible Device does not allow Cox to automatically update the Access Software, you are responsible for ensuring that the Access Software is up to date. If the Compatible Device allows Cox to automatically update the Access Software, you agree that Cox may update, upgrade, or change the Access Software remotely, and may make related changes to the settings and software on your Compatible Device, as necessary to support your viewing of Purchased Content. You will only use the Access Software in connection with viewing Purchased Content, and no other purpose. Your use of the Access Software is governed by the terms of any license that accompanied its download and/or installation.

Usage Rules

You, and all other user accounts associated with your Cox TV service, may not collectively stream more than three (3) pieces of Purchased Content at any given time. You can download up to three (3) copies of the same Purchased Content onto three (3) registered devices. To removed downloaded Purchased Content or remove registered devices, open the Contour App on your mobile device, select "Settings", and then chose the "Manage Devices". All purchases of Purchased Content are final and non-transferable. No substitutions, exchanges, or refunds. You shall not circumvent, remove, alter, deactivate, or degrade any of the content protections applied to the Purchased Content (including any registered device).

Cross-Platform & Parental Controls

You acknowledge and agree that all content purchased through your Contour set-top-boxes may be available to other users and user accounts associated with your Cox Service account number, on select Contour set-top-boxes or Compatible Devices used by those users. When you "purchase", "buy", or "own" Purchased Content, that content is not sold to you, rather it is licensed to you as follows:

Subject to your payment of all applicable fees, and subject to your compliance with these Terms, your Customer Agreement, and any other terms or conditions imposed by the applicable digital rights management technology used to protect the Purchased Content, Cox grants you a personal, limited, non-exclusive, revocable, non-transferable, non-sublicensable license to access and view the Purchased Content for your personal, residential, non-commercial use, for so long as Cox makes the Purchased Content available. Cox’s authority to provide the Purchased Content to you is subject to restrictions imposed by the third parties, such as iN DEMAND L.L.C. or other distributors that make Purchased Content available to Cox (“Content Providers”). These Content Providers may designate limited periods of time when Cox is prohibited from selling, providing and/or streaming certain Purchased Content to you, including Purchased Content that you have previously purchased. You will be able to again purchase, stream and/or view such Content at the conclusion of these restricted periods. Except for the foregoing limited license, no right, title or interest in any Purchased Content is transferred to you. You agree that this license does not permit you to copy (in whole or in part), sell, rent, lease, distribute, broadcast, sublicense, transfer, or otherwise assign any portion of any Purchased Content and/or any rights or license associated with any Purchased Content (including without limitation, any code or credentials that allow access to any Purchased Content).


Content that is purchased on one device, such as a Contour set-top box, may not immediately be available for viewing on otherwise compatible set-top boxes or devices running Cox’s Access Software.

Cox will make commercially reasonable efforts to ensure that Purchased Content is available for customer viewing and download. However, Purchased Content may become unavailable due to any number of reasons, including, but not limited to, content provider licensing and other restrictions, and Cox will not be liable to you if Purchased Content becomes unavailable for further use, at any time. If your purchase includes the ability to download Purchased Content, we encourage you to download that content immediately after purchase. You bear the responsibility for completing download and for all risk of loss of the Purchased Content. Being able to watch downloaded Purchased Content on a device requires that device to periodically connect to the Internet. If you do not periodically connect the device running Cox’s Access Software to the Internet, you may temporarily lose the ability to playback downloaded Purchased Content on that device until you reconnect it to the Internet.

Cancelling Your Contour TV Service

If you cancel your Contour TV Service, Purchased Content will no longer be available to you through Contour set-top-boxes, but you can continue to watch purchased titles using your Cox User ID and Password online at watchtv.cox.com or on your compatible mobile devices with Cox Access Software. You are responsible for providing Cox a valid contact email address at the time of your Contour TV service cancellation and for updating Cox with any future changes to your contact email address. Your contact email address is used for Cox User ID and Password recovery. Your contact email address will only be retained by Cox for seven years from your Contour TV service cancellation date.
