Service Assurance PlanSM Terms
and Conditions
We
are pleased that you have selected Cox Service Assurance Plan,
the inside wire repair plan provided by Cox Communications,
Inc. ("Cox"). By subscribing to the Cox Service Assurance
Plan, you agree to be bound by these Terms and Conditions.
Under
Cox Service Assurance Plan service, Cox will identify wiring
trouble locations within your home and repair Inside Telephone
Wire, telephone jacks, Inside Cable Wire and/or Internet wiring
and cable outlets.
"Inside Telephone Wire" is defined
as the wires that run from the connection point (usually a
small box
on the outside of your home) to the telephone jacks inside
your home.
"Inside Telephone Wire" does not
include complex wires or wires that are connected to your telephones
or other
equipment in your residence.
"Inside Cable Wire" is defined
as the wires that run from the demarcation point to the
television set and/or cable modem or video equipment.
"Inside Cable Wire" does
not include complex wires that are connected to your television
sets or other customer premises equipment.
Under the Cox Service
Assurance Plan, when Cox is notified by you of service problems,
Cox will identify whether the problem is with your Inside Telephone
Wire, Inside Cable Wire, telephone jacks or cable outlets or
whether other on site equipment may be the problem. If the
trouble is covered by the Cox Service Assurance Plan, Cox will
repair or correct the trouble in a reasonable manner.
You acknowledge
that Cox may reroute wire along baseboards and other locations
to avoid replacement or repair in drywall, plaster or other
materials. Cox will not remove pieces of wall, plaster, or
sheetrock to access wiring. You shall be responsible for
the cost of removing, repairing and replacing any wall, plaster
or sheetrock that is required to access wiring.
Excluded
from
Cox Service Assurance Plan coverage are the following:
Telephone
wire, internet wire and cable wire located beyond the demarcation
point outside of your home;
Repair or replacement of wire
connecting the telephone or other equipment to the telephone
jack
Rewiring after a home is destroyed or
damaged by fire, flood, earthquake, Acts of God, vandalism, gross
negligence
or willful damage
Initial installation of service and
the installation of new jacks, new wiring or rewiring. These
services will be performed at our regular installation and service
rates
Cable or data wiring that runs between
or among separate buildings, apartments or dwelling units in
a multi-tenant
property. If you reside in a multi-tenant building, campus or
military
housing, we suggest that you discuss inside wire repair responsibility
with the manager or owner of the building
Repair or replacement
of any existing telephone/internet/cable wire and telephone
jacks not installed or existing in accordance with accepted
industry standards as determined by Cox *
Inside cable
outlets and cable wire used to receive unauthorized cable service
Trouble or problems existing prior to
establishment of cable television service with Cox, or prior
to selecting Cox Service
Assurance service
Repair or replacement of telephones,
answering machines, television sets, VCRs, set-top boxes
used for channel
selection or equipment leased or provided for receiving
video or other services or any other equipment except that
some
equipment may be provided and maintained by Cox and may be
repaired or
replaced as part of your service.
Wiring that Cox is unable
to access.
Available
only to Cox customers not covered by other inside wire repair
plans. Cox may immediately, and without notice, suspend or
discontinue this service to a residence if service(s) are
no longer being provided to the residence by Cox or if any
misuse
or abuse of the service occurs or if a hazard or danger to
person or property exists which would prevent our technicians
from performing the work in a safe manner.
Subject to any
applicable rules or laws, Cox may discontinue the Cox Service
Assurance
service or change any of these Terms and Conditions. Cox
will provide thirty (30) days prior written notice of any
significant
changes in the Terms and Conditions. This notice may be included
in your monthly bill.
You may discontinue the Cox Service
Assurance service at any time by calling our customer service
office
(see Contact Customer Support for the phone
number).
Cox shall not be liable for any injuries
to persons or property arising
out of installations, maintenance or repairs performed in
connection
with the Cox Service Assurance service nor shall Cox be liable
for any other damages including, but not limited to, indirect,
incidental, special or consequential damages, arising from
the customer's use or inability to use such inside telephone
wire, cable wire, internet wire, telephone jacks or cable
outlets.
COX EXPRESSLY DISCLAIMS ALL IMPLIED
WARRANTIES RELATED TO THE
COX SERVICE ASSURANCE SERVICE. THIS DISCLAIMER EXPRESSLY
INCLUDES, BUT IS NOT LIMITED TO, DISCLAIMER OF ALL WARRANTIES
OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE. COX'S LIABILITY UNDER
THIS AGREEMENT IS LIMITED TO THE AMOUNT PAID UNDER THIS AGREEMENT.
To report a telephone or cable problem that you think may
be related to your inside wiring, please contact a Cox Customer
Support representative (see Contact Customer Support).
If You are not the owner of the Property where Cox will perform
these services, You hereby warrant and represent that you
have obtained all necessary permissions from the owner of
the building
and you will indemnify Cox from any liability arising from
a breach of the representation and warranty.
